# Regulatory Updates Powered by Good Face: August 2026 Edition

We're excited to share the August 2026 edition of our Regulatory Recap, powered by Good Face.

Our system has been updated with the most recent regulatory developments across key markets — including new Proposition 65 carcinogen listings in the United States, new substance controls under Canada's Environmental Protection Act, a draft amendment to the EU Cosmetics Regulation, updated ASEAN Cosmetic Directive annexes, and the latest Cosmetic Ingredient Review (CIR) safety assessments. ### Target Clean Household Essentials

The Target Clean Household Essentials policy was added to Good Face to reflect the latest restricted ingredients list for household products.

### United States: California Proposition 65

Effective July 17, 2026, California's Office of Environmental Health Hazard Assessment (OEHHA) added four substances to the Proposition 65 list of chemicals known to cause cancer, under the "Labor Code" listing mechanism following IARC Group 1 carcinogen determinations: Hydrochlorothiazide, Voriconazole, and Tacrolimus (added jointly), and Welding Fumes (added via a separate notice on the same date).

Businesses whose products or operations could expose Californians to these substances should assess their warning obligations under Proposition 65.

### Canada: Canadian Environmental Protection Act (CEPA)

Canada has added two new substances to the Domestic Substances List with Significant New Activity (SNAc) obligations, effective upon registration (Order SOR/2026-161): hexanedioic acid, 1,6-diisotridecyl ester (CAS RN 26401-35-4) and alkanedioic acid, di-branched alkyl ester (CAN 19814-2). Manufacturers and importers using either substance in cosmetics above the specified concentration and quantity thresholds must submit a Significant New Activity Notification at least 90 days in advance.

Two new Ministerial Conditions have also taken effect. Ministerial Condition No. 22434, in force since June 10, 2026, permits the manufacture and import of castor oil, monomaleate (CAS RN 241153-84-4) for use in body wash, shower gel, shampoo, conditioner, liquid hand soap, and toothpaste at up to 2.5% by weight. Ministerial Condition No. 22545, in force since May 29, 2026, permits the manufacture and import of 1-propanaminium, N-(3-aminopropyl)-2-hydroxy-N,N-dimethyl-3-sulfo-, N-(C12-18 and C18-unsatd. acyl) derivs., inner salts (CAS RN 691400-36-9), restricting its use in leave-on cosmetics to a maximum concentration of 0.6% by weight. Both conditions carry notification and five-year record-keeping obligations.

### European Union: Cosmetic Ingredients Regulation

On July 8, 2026, the European Commission notified the World Trade Organization of a draft amendment to Regulation (EC) No 1223/2009, commonly referred to as Omnibus Act IX. The draft proposes adding 16 substances or substance groups — including several CMR-classified substances such as Benzophenone-1 and Benzophenone-2 — to Annex II (prohibited substances), alongside changes to paraben-related preservative entries and to BHA.

The draft also introduces new Annex III entries, including Cannabidiol (CBD), and revises the restrictions on Hydroxyapatite (nano). As this amendment is still in draft form, its application dates are not yet finalized; manufacturers should monitor its progress before undertaking reformulation.

### Asia: ASEAN Cosmetic Directive

The ASEAN Cosmetic Directive annexes were updated to Version 2026-1. Annex II gains four new ingredient entries (1725–1728), and Annex III removes the "Except Indonesia" restriction on Genistein while adding two new entries (345 and 346).

Annex IV introduces limitations and requirements for CI 45430, while Annex VI deletes two existing entries (40 and 41).

### Cosmetic Ingredient Review (CIR) Findings

The CIR Expert Panel has finalized several safety assessments, including an amended report on Butoxyethanol, a safety assessment of Fatty Amphocarboxylates, a final report on Dimer Dilinoleates, and an amended report on 2-Nitro-p-Phenylenediamine addressing previously outstanding genotoxicity data.
