# Regulatory Updates Powered by Good Face: May 2026 Edition

We're excited to share the May 2026 edition of our Regulatory Recap, powered by Good Face.

Our system has been updated with the most recent regulatory updates across key markets - including U.S. state-level children's product chemical disclosure requirements, proposed updates to Canada's Cosmetic Ingredient Standard, new CEPA obligations, fresh SCCS opinions on widely used cosmetic ingredients, updated CIR safety assessments, new approved raw materials in China, and regulatory changes to ingredient status in Japan. ### United States: Maine Safer Chemicals in Children's Products

Maine’s Safer Chemicals in Children's Products Law requires manufacturers or distributors of children's products to disclose specific information when a designated priority chemical is present in a product above the de minimis level. The law applies a tiered chemical prioritization system: substances are first identified as chemicals of concern, then elevated to chemicals of high concern, and finally designated as priority chemicals; a status that triggers mandatory reporting obligations. Manufacturers selling certain categories of children's products in Maine that contain any of Maine's priority chemicals, in an amount greater than de minimis, must report to the Maine Department of Environmental Protection (DEP) within 30 days of the product's availability in Maine. This reporting requirement covers a broad range of product categories including cosmetics and personal care products. Affected manufacturers are also subject to a reporting fee administered by the DEP.

### United States: Vermont Toxic-Free Families Act (Act 188)

Vermont's Toxic-Free Families Act (Act 188 / 18 V.S.A. Chapter 38A) requires manufacturers selling children's products in Vermont to report to the Vermont Department of Health if those products contain any of the 86 currently listed chemicals of high concern to children (CHCCs). Reports are submitted through the High Priority Chemicals Data System (HPCDS) and are due on two specified dates each year: January 31 and July 31. A fee of $200 applies for each notice submitted. Cosmetics marketed to or intended for children under 12 years of age fall within the scope of this program.

### Canada Cosmetic Ingredient Standard

Health Canada has published proposed changes to the Canada Cosmetic Ingredient Standard, affecting both the restricted substances list and several existing entries. The proposed additions to the restricted list include: Basic Violet 4, Basic Blue 7, Polyaminopropyl Biguanide, Poly(hexamethylenebiguanide) hydrochloride, Guanidine N,N'''-1,6-hexanediylbis[N'-cyano-, polymer with 1,6-hexanediamine, hydrochloride, and Polyhexamethylene biguanidine. Several of these substances are polymeric biguanide-type preservatives that have faced increasing regulatory scrutiny in multiple markets. In addition, proposed revisions to existing entries affect a number of substances including Symphytum spp., Brucine, Brucine sulfate, Psoralen, Imperatorin, Alloimperatorin, 5-Methoxypsoralen, and 8-Methoxypsoralen.

### Canadian Environmental Protection Act (CEPA)

Several new regulatory actions under the Canadian Environmental Protection Act (CEPA) have been published in the Canada Gazette. This update includes new Significant New Activity (SNAC) requirements, a new ministerial order, and additions to the Domestic Substances List (DSL).

Effective March 25, 2026, Order 2026-87-20-01 introduced obligations for notification of any activity involving a number of substances if the total quantity involved across all activities in a calendar year exceeds 100 kg. Additionally, Hexanoic acid, 2-ethyl-, 2-ethylhexyl ester was added to Schedule 1. A separate SNAC order established that Cyclohexylamine and Ethylhexyl Ethylhexanoate are subject to Significant New Activity requirements, effective February 25, 2026.

### European Union: Scientific Committee on Consumer Safety (SCCS)

The EU Scientific Committee on Consumer Safety (SCCS) has published final opinions on three additional cosmetic ingredients: Cannabidiol (CBD), Silver, and Butylated Hydroxyanisole (BHA). These join previously published final assessments on Fullerenes, Hydroxylated Fullerenes and hydrated forms of Hydroxylated Fullerenes (nano), Butylparaben, Benzyl salicylate, and Water-soluble zinc salts used in oral hygiene products.

These final opinions carry significant regulatory weight, as they directly inform decisions by the European Commission on whether to restrict, limit, or prohibit the use of these substances in cosmetics under the EU Cosmetics Regulation (EC) No 1223/2009.

### China Raw Materials for Marketed Products

China's National Institutes for Food and Drug Control (NIFDC) has published the latest additions to its Raw Materials for Marketed Products list. This list tracks raw materials that have been used in cosmetic products already marketed in China and serves as a key reference for ingredient compliance under Chinese cosmetic regulations.

The most notable new addition is Saussurea Involucrata Callus Powder, a plant stem cell-derived ingredient approved for use at a maximum concentration of 4% in all cosmetic product types, with the exception of products that may pose a risk of inhalation.

### Japan Cosmetic Safety Standard

Two separate regulatory developments have been incorporated into the Japan Cosmetic Safety Standard in Good Face. First, Japan's Chemical Substances Control Law (CSCL) updated its list of Class I Specified Chemical Substances under Ordinances No. 32 and 34, with the changes taking effect on April 14, 2026. The revised CSCL list is maintained by the National Institute of Technology and Evaluation (NITE) and can be found [here](https://www.nite.go.jp/chem/jcheck/rireki.action?request_locale=en).

Second, as of March 23, 2026, Triheptanoin was approved as an active ingredient in pharmaceutical products in Japan, which triggers restrictions on its use in cosmetics. Under Japan's Standards for Cosmetics, cosmetic products are generally prohibited from containing pharmaceutical ingredients. To avoid market disruption, Japan's Ministry of Health, Labour and Welfare (MHLW) is permitting continued use of Triheptanoin at or below current concentrations while a formal temporary inclusion on the Positive List is being finalized provided that manufacturers guarantee the safety of their products in the interim.

### Cosmetic Ingredient Review (CIR) Findings

The Cosmetic Ingredient Review (CIR) Expert Panel for Cosmetic Ingredient Safety has published a new set of final safety assessments. This update includes 13 newly published final reports covering a range of cosmetic ingredient categories. CIR final assessments are an important reference for formulators, particularly when assessing ingredients for use in the U.S. market or preparing safety documentation for international markets such as China, where CIR conclusions are recognized as a key data source.
